Presiding over the lawsuit, a singlejudge Bench of Justice Madhav Jamdar ordered tech giants Google LLC, Meta Platforms, and other internet intermediaries to immediately remove specific artificial intelligence (AI)generated deepfake videos, morphed images, and unauthorized digital content. The court determined that the actor, who has spent over 25 years in the Indian film industry, had successfully established a strong prima facie case to protect her public persona from digital misappropriation.

In the official ruling, the High Court observed that the unauthorized creation and distribution of superimposed visual media directly violates an individual’s constitutional rights. Justice Jamdar noted that personality and publicity rights flow directly from Article 19, which guarantees freedom of speech, and Article 21 of the Indian Constitution, which protects the fundamental right to life, personal liberty, and living with dignity. The bench emphasized that public figures spend decades building public trust and an identity, which gets severely compromised when deceptive AI systems manipulate their likeness or generate fake interactive chatbot personas without consent.

The High Court pulled up major digital platforms, reminding them of their strict statutory due diligence obligations under the Information Technology (IT) Rules that govern web intermediaries. Justice Jamdar noted that if tech platforms start taking active, timely measures, the creators of such malicious content will naturally be discouraged. In an oral observation, the court cautioned that if international tech organizations fail to proactively police their spaces against malicious offenders, they risk becoming complicit in violating the fundamental rights of Indian citizens. Counsel representing Meta informed the court that the platform would remove the specific malicious links identified in the actor’s petition.

The civil suit, filed through Senior Advocate Venkatesh Dhond and solicitor Jai Munim, targeted approximately 275 websites hosting morphed visuals, fraudulent domain names, and commercial chatbot clones. The legal safeguard covers Zinta’s name, photographs, nickname, voice, mannerisms, caricature, and her globally recognized distinctive dimpled smile. Moving forward, the court clarified that if tech platforms encounter future takedown requests that they believe involve genuine photographs or legally permitted media, they can communicate their objections to Zinta’s legal team or approach the High Court for further directions.
